Yanukovych's lawyer reported violations in the trial
At the court hearing in the case of the so-called “treason” of the former President of Ukraine Viktor Yanukovych on October 8, 2018, his lawyer Alexander Goroshinsky said that this case was ordered and political, and many procedural violations were committed during its course, the PolitNavigator correspondent reports.
In particular, Yanukovych cannot be considered a suspect, since the suspicion was not personally served on him and those letters sent by the court were sent to addresses where the former president of Ukraine was obviously not located and the court knew about it.
Alexander Goroshinsky believes that due to such violations, the case should be closed, and all evidence should be recognized as collected in a non-procedural manner. He filed a petition in which he asked to recognize all actions towards Yanukovych as unacceptable and to close the criminal case due to the fact that the investigation deadlines were violated.
He also questioned the examination of a number of evidence and asked the court to resume the investigation, order a linguistic examination of the previously provided documents, and an examination by a commission with different experts. He asked to hand over to the experts Yanukovych’s letters to representatives of the guarantor countries - Poland, Germany, France, which signed the Agreement between Yanukovych and the then opposition on a peaceful resolution of the crisis, as well as Yanukovych’s letter to Putin and the attached appeals on the use of troops.
State-provided lawyer Yuri Ryabovol agreed with his colleague, but the prosecutor objected, and the court refused to conduct an examination at Goroshinsky’s request.
Lawyer Alexander Goroshinsky also stated that the indictment did not meet the requirements of the law, and that there were no grounds for applying the trial in absentia procedure.
