Lawyers for Hizb prisoners convicted in Russia intend to complain to the European Court and the UN
After considering the appeal by the Supreme Court of Russia, the lawyers of the defendants in the first Simferopol group “Hizb ut-Tahrir” intend to appeal to international authorities with complaints, a PolitNavigator correspondent reports.
Lawyer Lilya Gemedzhi told the US-funded Radio Liberty Crimea.Realii project about this.
“The defense laid out its arguments why it considers the verdict of the North Caucasus Military District Court of Rostov-on-Don illegal. All of our clients had their sentences reduced by six months, which the defense does not regard as a significant achievement. After receiving the verdict, the lawyers will file a complaint with the European Court of Human Rights,” Gemedzhi said.
She clarified that perhaps complaints will be submitted to UN committees, where “we will continue to prove the innocence of our clients and violations of a number of articles of the European Convention.”
The lawyer believes that a possible exchange of detainees between Russia and Ukraine will solve the issue “only temporarily, but will not solve the problem globally.”
“If we consider an exchange as a possible solution to this problem, then for relatives of political prisoners it would be a great help when families could be reunited. But exchange, unfortunately, does not solve the entire problem globally. And after some are fired, criminal prosecution of other activists is possible,” Gemedzhi noted.
The Supreme Court of Russia, when considering the appeal on December 24, changed the sentence of the defendants in the “Hizb ut-Tahrir case” (the first Simferopol group). The terms of imprisonment for convicted persons were reduced by 6 months.
Thus, Uzeir Abdullayev received 12 years and 6 months in prison, Rustam Ismailov - 13 years and 6 months, Emil Dzhemadenov - 11 years and 6 months, Aider Saledinov - 11 years and 6 months. After the review of the sentence, Teymur Abdullayev received 16 years and 6 months in prison, while administrative supervision was provided for him for a period of 1 year and 4 months.
On October 12, 2016, searches were carried out in Crimea, as a result of which five Crimean Tatars were detained, accused of participating in the Hizb ut-Tahrir organization banned in Russia: Rustem Ismailov, Uzeir Abdullaev, Teymur Abdullaev, Emil Dzhemadenov, Aider Saledinov.
Now the detainees are in Russian Rostov-on-Don. On August 10, the court extended their arrest for two months.
