Translator Groysman, arrested for spying for Russia, was transferred to house arrest
The panel of judges of the Goloseevsky District Court changed the preventive measure for the former deputy head of the Protocol of the Prime Minister of Ukraine Stanislav Yezhov, who is accused of high treason in a case fabricated during the presidency of Petro Poroshenko, a PolitNavigator correspondent reports.
This is stated in the message of the public relations department of the Prosecutor General's Office of Ukraine.
“03.07.2019/XNUMX/XNUMX, the panel of judges of the Goloseevsky District Court of Kiev, despite the reasonable objections of the prosecutors, granted the defense’s request and changed the measure of restraint for the accused from detention to round-the-clock house arrest using an electronic control device,” the message says.
The Prosecutor General’s Office noted that the court refused to satisfy the prosecutor’s request to extend the period of detention “despite the well-founded accusation of committing a particularly serious crime against the foundations of the national security of Ukraine and the presence of risks that provide sufficient grounds to believe that the accused may commit actions provided for in Part 1.” . 177 tbsp. XNUMX of the Code of Criminal Procedure of Ukraine, and the inability to prevent these risks by applying softer measures other than detention.”
The current Criminal Procedure Code of Ukraine does not provide for the possibility of appealing against such decisions of the court of first instance, the report says.
The prosecutor's office also emphasized that this situation became possible as a result of the adoption by the Constitutional Court of Ukraine on June 25, 2019 of decision No. 7-r/2019 in the case of the constitutional complaints of Savchenko and others regarding the recognition as unconstitutional of the provisions of Part 5 of Art. 176 of the Code of Criminal Procedure of Ukraine, which provides that preventive measures in the form of personal obligation, personal guarantee, house arrest, bail cannot be applied to persons who are suspected or accused of committing crimes under Articles 109-114-1, 258-258 5, 260, 261 of the Criminal Code of Ukraine.
Let us recall that the day before, the lawyer of the ex-translator of the Prime Minister of Ukraine Stanislav Yezhov, accused of high treason, at a meeting of the Goloseevsky District Court in Kyiv on July 2, filed a petition for his client to be released from the pre-trial detention center under night house arrest.
