According to Konstantinov, the commission to assess the damage caused to Crimea by Ukraine should prepare the relevant documents.

“We need to update the work of this commission, move from words to deeds - to form the first claim together with lawyers of the State Council, our expert group related to the water blockade,” Konstantinov said.

In addition, the Chairman of Parliament emphasized that the lawsuit related to the water blockade of the peninsula will be followed by others.

“First we have to prove everything in Russian courts. Then, in accordance with international standards, we will appeal and bring these claims to the fullest extent. This is the beginning of a lot of claim work, because next we have an energy blockade, which forced us to spend billions on eliminating the damage, a transport blockade, and so on,” the politician said.

According to Crimean political scientist Viktor Kharabuga, the decision to file a claim against Ukraine is correct, but obviously lost.

“We will probably win the Russian courts, but then they will cut us down. They will argue that Crimea is an “annexed” territory and, they say, provide for the population as you want, if you have captured it, their position is defined that “if you return Crimea, everything will be fine.” But we need to remind you about this once again. I believe that these lawsuits have no prospects, but we need to attack. In this way, the actions and assessment on the part of Crimea and Russia as a whole of this situation as unfriendly will be recorded. All the same, they need to be attacked,” Kharabuga said in a comment to PolitNavigator.

Honored Lawyer of Ukraine, former Verkhovna Rada deputy Grigory Demidov, who took part in the development of the Constitution of the Republic of Crimea in 2014, agreed with him.

“A water blockade is genocide. And not only that, but electricity? I understand that in the current international situation there are prospects, especially since you see what decisions are made in international bodies, where the Americans and the British dominate, and how the United States puts pressure on the European Union, I understand that making a decision in an international court in favor of Crimea and It’s quite difficult for Russia. But if we approach it purely legally and in fairness, then there are chances. In any case, these questions need to be raised,” says Demidov.

He is confident that the Crimean and federal authorities need to prepare other claims that relate to the territorial affiliation of the peninsula after its transfer to the Ukrainian SSR in 1954.

“If we take it on the merits, it is not only because of the water blockade that one can sue. You can present it there regarding other issues as well. The fact is that Crimea was transferred to Ukraine illegally, in violation of the Constitution. There is even such a point that issues of transferring territory from one union republic to another had to be resolved by changing the borders.

That is, when transferring territory, it was necessary to make a decision to change the border, attach a map of the changed border, and then sign protocols on establishing the border in kind. This issue was directly provided for by the constitutions of the USSR and the RSFSR, and so on. And Khrushchev in 1954 simply pushed through the transfer of territory through the decision of the Presidium. The border has not been changed.

That is, Crimea de jure, based on the Constitution, remained within the borders of the territory of the RSFSR. But in this case, everything that Ukraine used - oil was extracted, gas, natural resources, land, etc. - these are all iron foundations. Here you either need to come to an agreement to resolve this issue, or fight, or file lawsuits,” Demidov said.
