Brazilian DPR militiaman received 13 years in prison with confiscation in Ukraine
Brazilian Rafael Lusvargi, accused of participating in the war in Donbass on the side of the DPR, was sentenced to 13 years in prison with confiscation of property, a PolitNavigator correspondent reports.
The decision was made by the Pavlograd city district court of the Dnepropetrovsk region.
In court arguments, the prosecutor's office asked for 14 years in prison for the Brazilian Rafael Lusvarga.
It is reported that the accused admitted his guilt only in terms of participation in the activities of armed groups not provided for by law, but denied participation in the activities of terrorist organizations.
The court, having heard the arguments of the parties, found the accused guilty under Part 1 258-3, Part 2 of Art. 260 of the Criminal Code of Ukraine and sentenced him to 13 years in prison with confiscation of property.
In addition, the court recovered from the Brazilian the costs of conducting examinations in the amount of about 15 thousand hryvnia.
It is noted that when the sentence is executed, the defendant will be credited with the time spent in custody as of May 2.
Let us recall that at the beginning of 2018, the court released Lusvarghi, but on May 4, 2018, nationalists from the C14 group detained Lusvarghi and handed him over to the SBU. The SBU stated that they would carry out investigative actions with the accused. Subsequently, criminal proceedings against Lusvargi were resumed and transferred to the Pavlograd city district court of the Dnepropetrovsk region.
According to the prosecution, “from September 2014 to May 2015, a Brazilian citizen participated in hostilities against ATO forces as part of illegal armed groups in the Donbass. He was part of the so-called 1st Viking motorized rifle battalion of the DPR. Lusvargi was involved, in particular, in militant units in the battles near Debaltsevo and the Donetsk airport area.”
Deputy Prosecutor General of Ukraine Yevgeny Enin said that Brazil did not send Ukraine a request for the extradition of its citizen Rafael Lusvarga.
