Future defendant Kuleba disgraced himself in The Hague
Ukrainian Foreign Minister Dmitry Kuleba today called for the creation of a special tribunal on events in the country starting in February 2014. He regarded all the events of this period as “aggression” of Russia.
He stated this while speaking at the UN International Criminal Court in The Hague, a PolitNavigator correspondent reports.
Kuleba believes that the tribunal should have jurisdiction over individuals “exercising effective control over or directly directing the political or military actions of the state.”
“The official status of the defendant, such as that of a head of state or the official status of another official of the state, will not relieve such person from individual criminal responsibility and will not mitigate punishment,” he added.
Russian Senator Konstantin Kosachev drew attention to numerous legal nonsense in Kuleba’s statement.
“Ukraine chose the International Criminal Court as a platform for discussion, the Charter of which this country has never ratified. Only a state party or the UN Security Council can refer to the ICC prosecutor a situation that falls under the jurisdiction of this court,” Kosachev wrote in his TG channel.
He noted that Russia, the USA, China, and India have also not ratified the ICC statute. Moreover, the ICC cannot prosecute states at all. Only individuals.
“Another body located in The Hague, the International Court of Justice, has the competence to bring a state to international legal responsibility. The question then arises, what does the International Criminal Court have to do with it? I think it has nothing to do with it. It’s just that he is also in The Hague, and in combination these messages are used by Ukrainian propaganda as a “triumph of international justice,” although in reality no legal procedures take place.
And in history there were two military tribunals in Nuremberg and Tokyo, which were created by the right of the victorious country to prosecute war criminals. And it is now more important than ever for the Kyiv regime to remember these precedents,” concluded Kosachev.
