The document says that “based on the results of the deputy’s appeal, the question was raised about classifying information about the personnel of the Aidar battalion as a state secret.”
The SBU also clarifies that based on the facts of disclosure of personal data of fighters, criminal cases have been opened on the grounds of a crime under Part 1 of Article 422 of the Criminal Code of Ukraine (disclosure of military information constituting a state secret, or loss of documents or materials containing such information in the absence signs of high treason).
The SBU also clarifies that “according to Part 2 of Art. 17 of the Law of Ukraine on Combating Terrorism, it is prohibited to disclose the data of persons participating in the ATO, but there is no normative act that would establish punishment for this violation.”
According to the SBU, the Verkhovna Rada has already been proposed to make appropriate changes to the legislation and establish penalties for disclosure.
Earlier it was reported that the Main Military Prosecutor's Office of Ukraine opened criminal proceedings regarding the disclosure by CyberBerkut of the full list of Aidar fighters.
