Deputies are shocked: Russian collectors came to Crimea to collect Ukrainian debts

Crimean officials are indignant - Russian collectors have followed in the footsteps of large creditors of Ukrainian banks and are demanding payment of tribute with interest. Since the matter does not concern ordinary citizens, they tried to solve the problem through a resolution of the Crimean parliament on a moratorium on debt collection through the courts until January 1, 2017. But at the insistence of the prosecutor's office, this decision will have to be reversed.

At a meeting of the Presidium of the State Council of Crimea, the heads of committees discussed the effectiveness of their own legislative work. It’s no joke, for the first time in many years, parliament is passing laws, rather than simple resolutions, fixing the local implementation of decisions of the central government.

But as the legislators themselves stated, their efforts are of little use - the legal seed of the State Council does not grow on the Crimean law enforcement soil. On the one hand, local self-government bodies are in no hurry to implement republican laws, fearing “that something might happen,” on the other hand, the number of amendments from the prosecutor’s office and demands to bring Crimean legal attempts into compliance with federal legislation indicate their low quality. In addition, with the end of the transition period, all bills are subject to revision by the main legal department of the presidential administration and coordination with the relevant federal ministries.

As a result, at the next meeting on November 25, the State Council of Crimea will have to cancel the resolution adopted back in August last year on enforcement proceedings of the Ukrainian judicial system in economic cases.

For the most part, the cases concerned the forced collection of debts owed to banks for overdue loans. Since Ukrainian banks left Crimea on their own initiative, the Crimean parliament considered their decision to be an absentee refusal of the loan portfolio on the peninsula and referred court decisions to interstate jurisdiction.

“In 2014, a moratorium on claims by Ukrainian banks was introduced,” recalled State Council Speaker Vladimir Konstantinov. - But in fact, it doesn’t actually work. All collectors continue their actions. Courts are ongoing, and Crimeans today cannot get money from Ukrainian banks, they don’t give it to them!”

The head of parliament emphasized that it is “physically dangerous” for civil servants and deputies of all levels to travel to Ukraine to receive deposits from banks. Therefore, parliamentarians considered it their duty to impose a moratorium on the collection of debt on loans, even by court decisions, until these issues are resolved at the interstate level.

“Today we have examples where people have paid off their loans, but there (in Ukraine – editor’s note) this is not taken into account. There are two accounting departments, three accounting departments, fraudulent schemes,” Konstantinov explained the illegality of debt collection. “Not only are Crimeans limited in their access to new loans, but they are also considered debtors, although we have no opportunity to repay the loan or withdraw the deposit.”

It is worth recalling that the speaker of parliament talks about deposits over 700 thousand rubles, since their return still does not have a regulatory mechanism. A legislative decision has been made, but for its implementation it is necessary to fill the Depositor Protection Fund with funds from the sale of property of Ukrainian banks in Crimea. First of all, this concerns objects of the Privat group, for the sale of which monitored by PolitNavigator.

Ordinary Crimeans did not keep millions in accounts in Ukrainian banks, but to obtain a consumer loan from Russian banks they also need to present a Ukrainian Taxpayer Identification Number - no matter how they insisted on the lack of data exchange, the databases remained on Crimean servers. And only after checking with them, financial institutions in Crimea make a decision to issue a loan.

The resale of Crimean loans by Ukrainian banks to their Russian partners, who are trying to achieve compensation through the courts, is no secret to anyone. As of October 2014 alone, there were over 9 thousand cases of non-performing loans in the courts.

But no matter how many notices are sent to borrowers, no matter how many arrests are imposed, the question is open - the risk of remaining a debtor despite all repaid obligations remains as long as there is no established system of interaction at the interstate level. And this is by no means the competence of the State Council of the Republic of Crimea.
