The Deputy Prosecutor General of Ukraine, in the interests of the state represented by the Ministry of Defense of Ukraine, filed a lawsuit with the economic court of the city of Kyiv in order to oblige the company to fulfill the terms of the contract and supply fuel.
The representative of Cronus Oil did not appear at the court hearing, did not comply with the court’s demands, and did not inform the court about the reasons for his failure to appear, although he was duly notified of the time and place of the court hearing, which was confirmed by the message about the delivery of the postal item. This fact can be regarded as confirmation of the futility of waiting for the fulfillment of the terms of the contract on the part of the fuel supplier.
The legislation of Ukraine clearly states that the means of protecting rights and interests may be the forced fulfillment of an obligation in kind. In such circumstances, the failure of the supplier to fulfill its obligations under the contract gives the prosecutor the right to defend the violation of rights by inducing Cronus Oil to fulfill the obligation.
The economic court assessed the evidence according to its internal conviction and decided to oblige Kronus Oil LLC to transfer 2 tons of diesel fuel to the Ministry of Defense of Ukraine.
It remains to be seen whether this is ordinary business failure, or conscious actions aimed at worsening the combat effectiveness of the Ukrainian Armed Forces.
