The court left the former head of Naftogaz in custody. Defense claims numerous violations
Kyiv, March 28 (Navigator, Mikhail Ryabov) – The Kyiv Court of Appeal left in custody the ex-head of Naftogaz of Ukraine Evgeniy Bakulin, who was detained several days ago by security forces. His defender Valentina Telichko stated numerous violations, expressing confidence in the positive prospects for Bakulin and negative ones for the state of Ukraine in the European Court.
Telichko announced the continuation of law enforcement arbitrariness and the use of criminal prosecution against people disliked by the current government.
She told reporters about this when commenting on the court decision.

“Today we saw that nothing has changed in Ukraine – neither in law enforcement agencies, nor in the legal system. Law enforcement officers work arbitrarily and it is possible that there is an order for criminal prosecution. Judges simply turn a blind eye to these violations,” said Valentina Teichenko.
Evgenia Bakulin's representative to the ECHR stated that the court decided to reject the appeal of Bakulin's lawyers without weighing a number of indisputable evidence presented by the defense.
“At today’s meeting we saw a number of violations of European standards and Ukrainian legislation at the same time. Firstly, the time of detention was not documented in time - instead of an hour, it was indicated that it happened after seven o’clock.
Secondly, notifications of suspicion were not served on time. In addition, this message was not delivered by an authorized person. Since Bakulin is a deputy of the regional council, only the Prosecutor General or his deputies could serve him with notices of suspicion.
The court in the first instance chose which preventive measure to apply, working all night - from 21:00 to 06:00 in the morning. At the same time, neither the defense nor the suspect himself was given time to prepare for this court hearing. This is another very gross violation of the right to defense, and it also contains signs of torture. Because it is not intended to keep your face open without breaks, without food, without the opportunity to rest and satisfy other physiological needs - in a court hearing the whole night. It’s natural to sleep at night, and not solve court cases!” said Telichenko.
“Of course, there are so many violations that I have no doubt not only about the expediency, but also about the positive prospects for the plaintiff and the negative ones for the state of Ukraine when considering the case in the European Court. I started my work a few days ago, because it was clear where the case was going after the trial court. The application to the European Court will be filed in the coming days,” said representative Evgenia Bakulina at the European Court of Human Rights.
