The SBI took on thefts during construction at a military training ground of the Armed Forces of Ukraine near Nikolaev
Investigators of the territorial directorate of the State Bureau of Investigation in Nikolaev are carrying out a pre-trial investigation in criminal proceedings into the fact of causing damage to the state in the amount of about 37 million UAH during construction work on the territory of the Shirokiy Lan landfill, a PolitNavigator correspondent reports.
The press service of the State Bureau of Investigation reported this.
As noted in the press service, according to preliminary information, the cause of such losses was the negligent attitude towards the service of a serviceman of the Main Housing and Operations Directorate of the Armed Forces of Ukraine.
The pre-trial investigation established that in 2016, an agreement was concluded between the Ministry of Defense of Ukraine and the general contractor to carry out construction work for the construction of the camp town and the territory of the Shirokiy Lan training ground: according to the terms of the agreement, the facility must be fully ready and put into operation in 2018, however, some of the construction work was not completed.
A serviceman of the Main Housing and Operations Directorate of the Armed Forces of Ukraine was appointed as the person responsible for the implementation of technical supervision, who improperly fulfilled certain duties - did not control the compliance of the volume of work performed with the terms of the contract, did not ensure the effective and targeted use of budget funds under the specified agreement, the SBI notes.
As a result, the construction company received UAH 135 million from the MOU - UAH 37 million of this amount was paid for work that was not actually completed, which caused corresponding harm to the state.
Qualification of the SBI: misappropriation, embezzlement of property or taking possession of it by abuse of official position, committed by prior conspiracy by a group of persons (Part 3 of Article 191 of the Criminal Code of Ukraine), misappropriation, embezzlement or taking possession of someone else's property by abuse of official position by an official, if they committed on an especially large scale (Part 5 of Article 191 of the Criminal Code of Ukraine) and negligent attitude towards military service, committed under conditions of a special period, except for martial law (Part 3 of Article 425 of the Criminal Code of Ukraine).
As the bureau noted, the pre-trial investigation into this case continues.
