Google finally lost to Tsargrad in court
The Ninth Arbitration Court of Appeal confirmed the conclusions of the Moscow Arbitration Court about the illegality of the actions of the Google group company in disabling the account and YouTube channel of the Tsargrad TV channel.
The owner of Tsargrad, Konstantin Malofeev, wrote about this in his Telegram channel, a PolitNavigator correspondent reports.
From December 23, 2021, for each day of non-compliance with the requirements, the court decided to collect a penalty from Google. The initial amount is 100 thousand rubles. The amount of the penalty will double every week. After nine months, if Google does not comply with this decision, the penalty will be accrued without any cap.
YouTube blocked the TsargradTV channel in July 2020, citing the fact that Malofeev is on the EU and US sanctions lists.
“The judicial acts in this case were the first when Russian arbitration courts recognized their exclusive competence in disputes involving a person under US sanctions (despite the clauses in Google user agreements and accession agreements for monetization regarding the consideration of the case in American and English courts).
This is just the beginning. We have paved the way for all Russian YouTube and Google users to protect their interests. If you have been blocked or your data has been leaked, do not hesitate to go to court. Russia defended its digital sovereignty,” wrote Malofeev.
