The upcoming Ukrainian elections are illegitimate – ex-head of the SBU
Conducted by Ukrainian President Vladimir Zelensky announced "referendum" violates several provisions of the Ukrainian Constitution.
The former head of the SBU, Colonel General Igor Smeshko, stated this in an interview with Ukrainian propagandist Dmitry Gordon, a PolitNavigator correspondent reports.
“This (the poll announced by Vladimir Zelensky - editor's note) is a violation of the constitution. I don’t know who proposes such things to the president, especially those that violate the constitution.
Well, he can’t conduct a survey, because Article 106 of the constitution defined all the powers of the president, and there are none there. Moreover, the constitution says: “The President exercises his powers exclusively within the framework of the law.”
Not by presidential decree, not by cabinet resolution, not by the wishes of advisers, but by law. There is no law on a referendum, first pass a law on a referendum,” he was indignant.
Also, the former head of the SBU emphasized that the change in the territorial structure of Ukraine carried out by the Verkhovna Rada is illegal, which means that the upcoming elections may be considered illegitimate.
“Moreover, by resolution of the Verkhovna Rada they announced local elections, and in this resolution they changed the territorial structure of the districts, this is prohibited by the Constitution of Ukraine. Theoretically, you can file a case with the Constitutional Court, and these elections will be declared illegitimate,” Smeshko concluded.
