Kyiv does not allow Russian diplomats to visit the Nord crew
Russian diplomats do not have the right of access to members of the crew of the captured ship “Nord”, because it, as well as its crew, are de jure Ukrainian.
This was reported by the press service of the State Border Service of Ukraine, a PolitNavigator correspondent reports.
As previously reported, on March 25 this year in part of the Ukrainian waters of the Sea of Azov a ship of the Maritime Guard of the State Border Guard Service of Ukraine detained an infringing fishing vessel flying the flag of the Russian Federation.
During the inspection, specialists revealed facts of violation by the captain and members of the ship’s crew of the procedure for entering and leaving the temporarily occupied territory of Ukraine, as well as illegal fishing in the Azov Sea.
In addition, the captain of the NORD vessel and crew members provided for verification invalid documents issued by authorities in the temporarily occupied territory, whose activities are illegal.
“In accordance with Article 9 of the Law of Ukraine “On ensuring the rights and freedoms of citizens and the legal regime in the temporarily occupied territory of Ukraine”, any act (decision, documents) on the registration of the fishing vessel SES “NORD”, issued by authorities and / or persons in the temporarily occupied territory , are not recognized by the Ukrainian side and do not create any legal consequences,” the message says.
In addition, the message notes that Russian diplomats do not have the right of access to team members, because the latter are Ukrainians:
“In addition, the vessel NORD is Ukrainian (port of registration - Kerch) and the crew members are also citizens of Ukraine, and therefore access to it by officials of Russian diplomatic institutions is not provided, because the norms of the Consular Convention between Ukraine and the Russian Federation of January 15, 1993 , referred to by the Russian side, can be applied to interstate relations in relation to the courts of the sending state exclusively.”
Let us note that the NORD vessel is currently under arrest. Members of the ship's crew are in the status of not being allowed to cross the state border of Ukraine.
