Investigating judge of the Pechersky District Court of Kiev Olesya Batrin determined that the complaint about the inaction of the Deputy Prosecutor General of Ukraine - Prosecutor of the Odessa Region David Sakvarelidze (which was expressed in the failure to enter information about a criminal offense into the Unified Register of Pre-trial Investigations after receiving a statement about a criminal offense) will be considered outside of Kyiv , informs the Unified Register of Judicial Decisions.
“From the materials attached to the complaint, it can be seen that the statement about the commission of a criminal offense by the head of the second investigative department of the prosecutor's office of the Odessa region was Yu.A. Morvanyuk. the applicant submitted to the prosecutor of the Odessa region D.G. Sakvarelidze, and not to the General Prosecutor's Office of Ukraine, the deputy (head) of which is Sakvarelidze D.“, the court ruling says.
Taking into account the above, the judge determined that the complaint was not subject to consideration in the Pechersky District Court of Kyiv, since the prosecutor's office of the Odessa region is located outside the territory of operation of the Pechersky District Court of Kiev.
“Taking into account the above, this complaint in accordance with Art. 304 of the Code of Criminal Procedure of Ukraine must be returned to the applicant for presentation to the appropriate court in Odessa at the location of the prosecutor’s office of the Odessa region,” the judge noted.
