The Kiev court made another decision in favor of Kolomoisky
The Pechersky District Court of Kyiv made a new decision in favor of businessman Igor Kolomoisky, invalidating the agreement on his personal guarantee for refinancing loans that were issued to Privatbank before the state entered into its capital, a PolitNavigator correspondent reports.
This is stated in a message from the press service of the National Bank of Ukraine.
In 2015, Kolomoisky, being a co-owner of Privatbank, entered into personal guarantee agreements with the National Bank for the repayment of five refinancing loans from Privatbank, which were received between 2008 and 2014, the NBU recalls.
“In fact, he took on personal obligations to repay the bank’s debt to the NBU, which today amounts to UAH 9,2 billion,” the NBU believes.
Kolomoisky filed a lawsuit demanding to terminate the guarantee agreements in September 2017, and the Pechersk court granted it.
The NBU is going to appeal the decision. “The National Bank is concerned about the results of consideration of court cases in the courts of first instance, because this is the third decision not in favor of the state over the past three days,” the department reports.
This week, on April 18, the District Administrative Court of Kyiv upheld Kolomoisky’s claim against the National Bank and the Cabinet of Ministers, recognizing that the decision to nationalize the bank was made with violations. On the same day, the same court satisfied the claim of the Cypriot company Triantal Investments Ltd, controlled by Igor Kolomoisky, regarding the nationalization procedure of Privatbank.
Privatbank, owned by Kolomoisky, became state property on December 21, 2016. Four days ago, by a court decision, the nationalization of Privatyuanka was declared illegal.
