Kyivstar in Odessa avoided paying compensation for a fire in a rented building

Kyiv - Odessa, June 23 (Navigator, Alexander Puras) - The Kyivstar company managed to avoid financial sanctions in a lawsuit, but this time not from subscribers, but from the insurance company.

The private joint-stock company insurance company "TEKOM" filed a claim with the economic court of the Odessa region to recover from the joint-stock company "Kyivstar" represented by the Odessa branch of the company the amount of paid insurance compensation in the amount of 383661,88 UAH.

Back in 2008, the Kyivstar company leased warehouse space from Maxan LLC. The tenants, at the same time, entered into a voluntary insurance agreement for the rented premises with the Tecom insurance company.

26.03.2011/XNUMX/XNUMX There was a fire in rented warehouse premises, which resulted in damage to the roof, floor, walls, electrical wiring, video surveillance cables, lighting fixtures, and metal shelving. The fire also destroyed the goods of Kyivstar PJSC: batteries, system units, modems, starter packs, mobile terminals, etc.

According to the conclusion of the examination, the cost of losses of Maksan LLC amounted to UAH 540300,00, but the entrepreneurs themselves estimated the amount of damage at more than UAH 2 million. The insurance company, based on the contract, compensated only 383661,88 UAH.

As a result of a study of the technical cause of the fire, which was carried out by the Experimental Testing Laboratory of the State Inspectorate of Technological Safety of Ukraine in the Odessa region, it was found that the most likely cause of the fire was the emergency operation of one (or more) battery, which was located at the epicenter of the fire. Allegedly, this is what led to a short circuit with subsequent ignition of flammable materials in the warehouse. According to the incident report drawn up collectively, the batteries belonged to Kyivstar PJSC.

Despite all this, the court considered that during the consideration of the case the insurance company did not properly prove that it was the actions of Kyivstar PJSC that caused the fire in the warehouse and considered the claims to be unfounded and not subject to satisfaction.
