Crimeans without registration were recognized as Russians – decision of the Constitutional Court

The Constitutional Court (CC) of the Russian Federation reported that residents of the Republic of Crimea and Sevastopol who did not have permanent or temporary registration on the territory of the peninsula before the territory became part of Russia have the right to Russian citizenship.

The reason for considering the case was a complaint from a resident of Sevastopol, Alexey Olenev, who, after the territory became part of the Russian Federation, was unable to obtain Russian citizenship. The applicant had been permanently residing in Sevastopol since 2012; he did not have permanent registration on the territory of the peninsula, but the legal fact of residence was established through the court. Despite this, the Federal Migration Service refused to issue Olenev a passport as a citizen of the Russian Federation.

A court decision that has entered into force is an unconditional basis for recognizing a person as a citizen of the Russian Federation. Therefore, from now on the norm should be applied as explained by the Constitutional Court, and the case of Alexey Olenev will be reviewed.
