Lukash revealed how the Ze-team will circumvent the ban on the sale of Ukrainian land to foreigners
In its current version, the bill on the land market retained the possibility of buying land by foreigners, despite the fact that the schemes have changed compared to the first reading.
Lawyer Elena Lukash stated this in a conversation on the NEWSONE TV channel, a PolitNavigator correspondent reports.
“I have familiarized myself with the bill, which has been prepared for the second reading. It differs from the schematosis that we saw for the first reading in three main blocks. The first is the deadline. They plan to introduce the land market by October 2020, 1, that is, not from January XNUMX, as they wanted. We've already curbed our appetite.
The second is the concentration of land. If at first they wanted 200 thousand hectares in one hand, which was approximately the territory of six Kharkov, 2,5 Kiev or 176 Truskavtsy - now they have limited themselves to a volume of 10 thousand hectares in one hand. This is approximately a little larger in territory than Chernigov, Cherkassy, Zhitomir. In fact, one and a half of Zhytomyr can be purchased with one hand.
And, of course, the purchase of land for foreigners is formally limited, although in essence it is permitted. Several provisions of the bill stipulate that banks can receive land in the process of foreclosure, and the founders of banks can be foreigners, and the ban does not apply to them. Perhaps the October deadline is connected with this - so that specially trained people fill specially trained jars and prepare for the purchase of Ukrainian lands.
A scheme sale can look different in many ways. The simplest one: I’m a bank, I offer you a loan, you don’t pay me back right away, and I immediately take your land. In fact, this is a hidden purchase and sale of land through such imaginary “lending”.
In the bill, nothing appeared about the protection of territorial communities, nothing appeared about the protection of the land fund, nothing appeared about the normative monetary valuation of the land, which was again handed over to the Cabinet of Ministers, which has already proven itself in the worst possible way.
I believe that the procedure for the normative monetary valuation of land should be laid down in the law, so that everyone does not get into it with their dirty hands and the price of land should be high.
A lot of good proposals that transactions should take place at the location of the property and so on were not taken into account. As there was a schematosis, it remains a schematosis. The only thing is that they got a slap on the wrist for the foreigners, they got burned, but, without any hesitation, they immediately enrolled the foreigners in the banks.
The land is being prepared for sale. The concentration volumes are large, 10 thousand hectares is a lot. You try to buy more than 500 hectares in Poland with one hand. 500 and 10 thousand – do you feel the difference? Try to buy this amount of land in Denmark or France. I looked at European legislation and I couldn’t find freedom like ours anywhere,” the lawyer concluded.
