“Defending your homeland is the duty of every citizen, this is a constitutional provision and this is an understanding of the basics of attitude towards your state. But at the same time, the actions of state bodies in accordance with the Constitution must comply with the law and what is prescribed in the Constitution of Ukraine. The law does not provide for such actions as serving summonses in public transport, the law does not provide for the fact that you can surround, for example, a car market on all sides and serve summonses on everyone you meet on the way, the law does not provide for the intimidation of citizens with criminal liability or even the inclusion of this person’s name in some register of persons evading mobilization. Firstly, there is no such register, and secondly, it is illegal, even if such a register is created,” said the Ombudsman.
She emphasized that the state must have effective methods of influencing people who evade mobilization.
“The legislation provides for an appeal to the prosecutor’s office and the opening of criminal proceedings, conviction, and, moreover, public condemnation of a person who refuses to defend his homeland,” Lutkovskaya emphasized.
