The first President of the Republic of Crimea, Yuri Meshkov, addressed an open letter to the FSB regarding the official response of the State Council of the Republic of Kazakhstan to the appeal of Crimeans calling for the removal of the criminal record of the fighter for Russian Crimea Valery Podyachiy, who was convicted in 2011 by the Court of Appeal of the Autonomous Republic of Crimea for calls for the reunification of the peninsula with Russia.

“On Monday, the mass media disseminated information,” notes the appeal, the text of which is available to PolitNavigator, “that the State Council of the Republic of Kazakhstan offered a fighter for Russian Crimea to a fighter for Russian Crimea convicted by a Ukrainian court (we are talking about the leader of the Sevastopol-Crimea-Russia movement, Valeria Podyach).” compensate for the harm caused by the crime. Let us recall that Podyachy and his associate Semyon Klyuev were sentenced under Article 110 Part 2 of the Criminal Code “Encroachment on the territorial integrity and inviolability of Ukraine” to three years in prison. The SBU accused them of organizing and holding a press conference on January 21, 2008, during which a press release was announced, the last paragraph of which contained the text: “In order to prevent dramatic events for the residents of the peninsula, the Crimean parliament must immediately implement the results of the referendum on January 20, 1991, which means repealing the 1998 Constitution of the Autonomous Republic of Crimea, as contrary to the will of the Crimean people, and adopting a Declaration on the reunification of Crimea with Russia. Then declare the peninsula a territory under the jurisdiction of the Russian Federation, as well as remove occupation symbols from the building of the Supreme Council of Crimea and oblige all local authorities in Crimea and other institutions subordinate to them to display the state flags of Russia (italics by Yuri Meshkov - PolitNavigator)".

The verdict, the President of the Republic of Kazakhstan reminds, has not yet been canceled, although it has been reviewed in all judicial instances.

“The damage caused by the crime under the article for “separatism” consisted of calls for the return of Crimea to the jurisdiction of the Russian Federation. This was stated in the verdict of the Ukrainian court against Podyachiy and Klyuev. The Crimean parliament, six years after the announcement of the press release of the “Sevastopol-Crimea-Russia” movement, implemented the same scenario to which the participants in the scandalous press conference of the Popular Front “Sevastopol-Crimea-Russia” on January 21, 2008 publicly called on it. Now, following logic leadership of the State Council, the convicted person must compensate for the damage caused by the encroachment on the territorial integrity and inviolability of Ukraine, that is, return Crimea back to Ukraine,” notes Yuriy Meshkov.

Since the leadership of the State Council, he adds, indicated this in response to the collective appeal of the public organization “Bloc of Patriots of Crimea - Unconquered Bastion”, then such actions of the Chairman of the State Council Vladimir Konstantinov “can be regarded as public calls for actions aimed at violating the territorial integrity of the Russian Federation, containing elements of a crime provided for in Article 280.1 of the Criminal Code of the Russian Federation.”

“I ask you to consider this statement as an open appeal to the FSB with a demand to initiate a criminal case under Part 4 of Article 33 - Article 280.1 of the Criminal Code of the Russian Federation against Vladimir Konstantinov. According to Part 4 of Article 33 of the Criminal Code of the Russian Federation, V. Konstantinov is an instigator, i.e. a person who attempts to induce another person to commit a crime through persuasion, bribery, threat or other means.

Ukraine has estimated the damage from the “loss of Crimea” at a trillion dollars. Judging by the latest data on the incomes of deputies and senators, they may well organize a charity marathon and help our convicted people raise the amount required by the Chairman of the State Council V. Konstantinov to have their criminal record cleared,” writes the first president of the Republic of Kazakhstan.
