Today's decision by the International Tribunal for the Law of the Sea in Hamburg, which supported Ukraine's position and called on the Russian Federation to release the detained participants in the provocation - an attempt to break through the border of the Russian Federation near the Kerch Strait, it is customary in the absence of arbitration jurisdiction to consider this situation.

“On May 25, in Hamburg (Germany), the announcement of the decision of the International Tribunal for the Law of the Sea (ITLS) on ordering provisional measures on the claim of Ukraine concerning irresponsible provocation in the Kerch Strait area involving three Ukrainian warships in November 2018. Russia did not participate in the hearings on interim measures.

As previously repeatedly noted by the Russian side, statements made by both Russia and Ukraine when signing and ratifying the 1982 UN Convention on the Law of the Sea exclude the possibility of using the dispute resolution procedures provided for by the Convention in relation to the incident on November 25, 2018 in the Kerch Strait region,” – the statement says.

It is also clarified that at this stage we are not talking about the consideration of Ukraine’s claims.

“During the subsequent arbitration proceedings, we intend to consistently defend our position, including the lack of arbitration jurisdiction to consider this situation in the light of the circumstances mentioned above. It was possible to avoid its occurrence provided that the requirements of Russian legislation regarding navigation in this area were observed. We call on the Ukrainian side to act this way in the future,” the Russian Foreign Ministry emphasizes.
