What violations does Kyiv commit during the “Anti-Terrorist Operation”: A lawyer’s assessment

...The fundamental element of any restriction (rule, law) is responsibility for its violation. And as long as the enforcer of compliance with the established restriction is able to use the means entrusted to him to ensure the inevitability of responsibility (punishment), there will be order in the territory where this norm applies.
For example, on the Kiev Maidan in the winter of 2014, the state leadership was unable to ensure that radical elements were held accountable for the crimes committed.
The direct consequence of these events was protests, and then an armed conflict in the southeast of Ukraine. The leaders of the Maidan do not know how to cope with a situation in which entire cities refuse to obey them. Official Kyiv confuses the civil war with an anti-terrorist operation.
The Ukrainian leadership persistently denies the fact of the civil war, which is natural, since otherwise the IMF will postpone the provision of financial assistance, which is like death for the state budget. This means that the official version of the fighting in eastern Ukraine will be the “fight against terrorism.”
The Law of Ukraine “On the Fight against Terrorism” has the following definition: anti-terrorist operation – a set of coordinated special measures aimed at preventing, stopping and stopping criminal acts carried out for terrorist purposes, releasing hostages, neutralizing terrorists, minimizing the consequences of a terrorist act or other crime, carried out for terrorist purposes.
In addition, the same law contains an exhaustive list of subjects in the fight against terrorism. This is, starting from the Security Service of Ukraine and the Ministry of Internal Affairs, and ending with central and local executive authorities, local governments, enterprises, institutions, organizations, regardless of subordination and form of ownership, their officials, as well as citizens with their consent.
The next article defines the powers of state bodies during anti-terrorist operations, but Art. 6 is specifically devoted to the powers of other entities that are involved in the fight against terrorism, namely:
“The entities that are involved in the fight against terrorism, within the limits of their competence, take measures to prevent, detect and stop terrorist acts and crimes of a terrorist nature; develop and implement preventive, regime, organizational, educational and other measures; provide conditions for conducting anti-terrorist operations at facilities that belong to the sphere of their management; during the conduct of such operations, provide the relevant subsections with material, technical and financial means, means of transport and communications, medical equipment and medicines, other means, as well as information necessary to carry out tasks regarding the fight against terrorism.”
What is Kyiv doing? Hastily gives the radical gangs of Euromaidan the status of security forces. He brings the army “to life” and mobilizes reservists, simultaneously collecting money to provide for this army in every possible way, even for 5 UAH. per resident!
The collected funds are accumulated in public organizations or from activists who purchase truly necessary items and ammunition, then they are delivered to military units and checkpoints. At the same time, no one puts these things on the balance sheet, which means no one is responsible for them. Consequently, expensive equipment, uniforms, protective equipment and even weapons can be appropriated or sold to military personnel or reservists - there is no liability!
The current leadership of Ukraine did not notice or did not notice how the oligarchs and presidential candidates began not only to collect money and “cookies” for the army, but also began to collect their own armed forces. For example, Oleg Lyashko even decided to personally participate and direct the actions of his henchmen in eastern Ukraine.
The list of articles of the Criminal Code of Ukraine that are violated by both authorized fighters against terrorism and the “neo-Makhnovist” gangs that support them would take several pages. This has already become commonplace, and impunity, as we know, gives rise to more cynical acts. Nationalist groups and private armies of oligarchs demonstrate their firearms to Western media operators, set fire to buildings with civilians inside, and torture detainees. International organizations pretend that they do not see all this, since they are not able to respond effectively, and admitting their powerlessness means calling into question the structure of all European legal institutions and provoking the collapse of the EU.
Social networks play an important role in popularizing lawlessness in Ukraine. They call ideological activists to rallies, select “titushki” for actions for money, and circulate amateur videos of murders. Moreover, the more cynical the crime, the more “likes” the author will get. Previously, criminals destroyed evidence and “removed” witnesses, but now, in the presence of dozens, or even hundreds of fellow citizens, they kill dissidents with extreme cruelty and film it on video, broadcasting it online. On these same social networks, “Batka Lyashko” regularly shares, in his opinion, the successes of his gang in the fight against terrorism. Here, the head of the Ministry of Internal Affairs of Ukraine, Arsen Avakov, reports on the progress of the ATO and, in fact, manages the ministry entrusted to him in the same way.
What can we say about ordinary performers, if even the leaders of Ukraine do not see the difference between the concepts of “separatist” and “terrorist”. Where is the criterion by which an Alpha fighter or a Ukrainian Armed Forces soldier will distinguish one from the other? Or was this criterion found in Odessa on May 2 of this year, when people with St. George ribbons were burned alive in the House of Trade Unions, compared to Colorado beetles?
Finally, I would like to give another, this time literary, definition of an anti-terrorist operation - a euphemism behind which hides the conduct of permanent hostilities on any territory (within the borders of one’s state). Such military operations make it possible to effectively steal financial resources (“war will write off everything”), maintain the authority of the authorities (during periods of falling ratings, advertising campaigns are carried out in the form of victorious operations), and also carry out hidden genocide of the population of one’s own country (sending men who are in at the most working, fertile and passionate age).
For the successful implementation of anti-terrorist operations, it is necessary to have elusive bogeymen, in whose name the “terrorism” of the civilian population is carried out and the policy of terrorism is pursued. The presence of such bogeymen (“odious individuals”) makes it possible to keep the population in fear and justify the conduct of anti-terrorist operations in principle. So for Ukraine and its allies, the “Little Green Men” became such bogeymen, as the personification of Russian special forces.
