The Kyiv District Administrative Court found it illegal and decided to cancel government decree No. 8 of June 2016, 365 on the implementation of social payments to internally displaced persons, a PolitNavigator correspondent reports.

This is stated in the court ruling published in the Unified State Register of Judicial Decisions.
“Recognize as illegal and cancel the resolution of the Cabinet of Ministers of Ukraine No. 365 of 08.06.2016/XNUMX/XNUMX “Some issues of the implementation of social payments to internally displaced persons,” the court ruling says.
Government Decree No. 365 provided, in particular, that structural units for social protection issues must carry out inspections of the place of residence of displaced persons and draw up an inspection report on the living conditions of the displaced family.
Now, according to the court decision, the procedure and grounds for assigning social payments to all pensioners or certain categories of them must be provided directly in the law and cannot be introduced by secondary legal acts.
The resolution notes that this resolution was adopted beyond the powers of the defendant and without observing all procedures provided for by law that must precede its adoption.
