Naftogaz proclaimed another virtual “victory”

Lawyers and attorneys for Naftogaz managed to push their position in the Hague Arbitration Court and convince the court that the blame for the losses of the Ukrainian company lies with Russia, but the court will “consider” the issue of the amount of compensation for another year.

“Late the day before yesterday, NJSC Naftogaz of Ukraine issued a decision of the Hague Arbitration, which considered the issue of Naftogaz’s claim regarding lost assets in Crimea and on the Black Sea shelf. The decision is positive. We were able to prove to the tribunal, firstly, the fact that the jurisdiction of this tribunal for the protection of investments extends to this case,” he noted.

Kobolev has also already prepared a claim from Russia, estimating Ukraine’s “losses” at five billion dollars, and expressed hope that in a year Naftogaz will receive a decision from an international court on this issue.

“Secondly, we were able to prove that Russia, as a state, is to blame for the loss of our assets and must answer for it, that is, pay compensation to NJSC Naftogaz of Ukraine. We estimate the amount to be approximately 5 billion US dollars, but the final decision on the amount will be the subject of the next hearing, which we expect this year, and we hope to receive a decision on the amount of compensation early next year,” he dreamed.

It should be noted that RIA Novosti, with reference to the press service of the Ministry of Justice of the Russian Federation, reported that Russia does not recognize the partial decision of the Hague Court on the claim of Naftogaz due to the fact that the Russian side did not participate in the proceedings, since the arbitration does not have jurisdiction to consider claim by a Ukrainian company.

Naftogaz considers gas drilling rigs in the Black Sea to be its “property” in Crimea, despite the results of the referendum on the reunification of the peninsula with Russia. The Ukrainian side has already tried several times to arrange provocations, including committing air raid on drilling rigs, however, the Russian military and border guards every time drive away overly curious Ukrainian “colleagues”.
