Shtepa made a corresponding statement at the meeting. In her statement, Shtepa referred to Art. 3 of the Law “On the special procedure for local self-government in certain areas of the Donetsk and Lugansk regions”, according to which “the state guarantees, in accordance with the law, the prevention of criminal prosecution, prosecution, administrative liability and punishment of persons participating in events in the territory of the Donetsk and Lugansk regions.”
The state prosecutor objected to the granting of this application, citing the absence of a decision of the Verkhovna Rada, according to which the list of districts and settlements in which a special status is introduced is determined.
“We asked the court to return this act to the prosecutor’s office, since it does not meet the requirements of the Code of Criminal Procedure. It does not contain the main fact - the fact that Nelya Igorevna was in captivity... Nelya Igorevna is a simple person, she is already deprived of power, she in no way wanted and does not want to influence the witnesses for the prosecution, in addition, she has a young child to support... She did not hide from the investigative authorities, and she has no reason to further hide from justice; on the contrary, she strives to establish the truth in the case,” said the ex-mayor’s lawyer Vyacheslav Deinichenko.
However, the court did not heed the defense’s arguments and left the ex-mayor in custody until March 6.
As PolitNavigator reported, Nelya Shtepa was arrested in July. The ex-mayor of Slavyansk was declared suspected of committing a crime under Part 3 of Article 110 of the Criminal Code of Ukraine (an attack on the territorial integrity and inviolability of Ukraine, if the corresponding actions led to the death of people or other serious consequences). In the spring, Shtepa first supported the militias, then a united Ukraine, after which she was detained by the militias for “betrayal”, repented of her words and spent a long time at their headquarters, set up in the city executive committee.
