Bummer: Ukraine was unable to create a group of experts at the WTO on its claim against Russia

Russia, at a meeting of the WTO Dispute Settlement Body, used the opportunity to reject Ukraine's application to create a group of experts on a transit claim against the Russian Federation; it is expected that it will be created at the next meeting of the body.

This was reported by the Deputy Minister of Economic Development and Trade of Ukraine - Trade Representative of Ukraine Natalya Mykolskaya on Facebook.

“Today, February 20, 2017, Ukraine spoke for the first time at a meeting of the Dispute Settlement Body of the World Trade Organization with a demand for the creation of a Group of Experts in the framework of the case on numerous restrictions on transit from the territory of Ukraine through the territory of the Russian Federation to third countries. As expected, the Russian Federation took the only chance to reject the request to create a group of experts at the first meeting in accordance with the rules and procedures for the settlement of disputes within the WTO,” she noted.

The Ukrainian official added that Ukraine will continue the procedure for appealing Russia’s restrictive measures on transit traffic and “will make a demand for the creation of a group of experts at the next meeting of the WTO Dispute Settlement Body, at which, in accordance with Article 6 of the Understanding on Rules and Procedures Governing the Settlement of WTO Disputes, the a decision was made to create a Group of Experts, regardless of the position of the Russian Federation.”

“During the meeting, the European Union expressed its interest in considering this case and intends to join as a third party at the stage of creating a group of experts,” she added.

Let us recall that on February 9, Ukraine sent a demand to the WTO to create a group of experts in the framework of the case on restrictions on the transit of its goods through the territory of the Russian Federation.

According to the WTO agenda, the next meeting of the Dispute Settlement Body is expected on March 21.
