The decision of the International Criminal Court, which issued an arrest warrant for Russian President Putin, does not oblige all states that have acceded to the convention to detain the Russian leader on their territory.

“For all our desire to see Putin behind bars in The Hague, all these international treaties are written in rather mild formulations so that as many countries as possible join them, and then a convention of this type receives international force. Therefore, a country that has signed such a convention has an obligation to arrest, but no punishment if it fails to do so. Therefore, many countries will play on this, and if Putin comes to some friendly country that is a member of the Rome Statute, it will not arrest him.

Russia will simply use this to demonstrate that nothing will happen to it. Therefore, another question arises here: to what extent will all the tough statements be turned into actions, and the countries themselves will look at this and say: okay, we also need to do something like this.”

At the same time, the propagandist believes that not many world leaders will refuse to shake hands with a “criminal,” at least one suspected of a crime.

“I think that many world leaders will not only shake his hand, but also kiss it out of great emotion. And even some members of the European Union, for example, Orban, who will continue to show sympathy for Putin,” Sumlenny was angry. “I don’t think that Scholz will have any problems conducting telephone conversations with Putin, because it will be presented as diplomacy, as negotiations, “to reduce the degree of escalation.”

Another thing is that at the diplomatic level, Putin’s statements and promises have lost their weight. Because until this moment in Germany, the negotiation process with Russia was presented as with a country - a permanent member of the UN Security Council, a participant in the grain deal, climate and economic programs. If the current head of the country is now on the international wanted list as a criminal, this already changes the situation. Because there were no such precedents.

The International Criminal Court has never put on the wanted list a statesman who has not been removed from his obligations, much less a head of state, much less a permanent member of the UN Security Council. What to do about this is not entirely clear, because there are no legal structures for this.

International law in this case is very contradictory; the head of a state cannot simply be arrested. In fact, we see the creation of certain new framework conditions for the application of international law. Because it is based in many of its parts on precedents, and generally applicable practice is not prescribed anywhere. But everyone does it, because it’s a tradition, and if there is no tradition, then everyone will do it in their own way on their own, and then some new method of application will crystallize.”

A trans-Ukrainian living in Germany complained that there are still quite a lot of supporters of normalizing relations with Russia, and in any decision of the collective West they see “the hand of Washington and a step towards escalation.” True, in order not to be upset at all, he suggests “not paying attention to it.”
