Naftogaz of Ukraine may lose its claim against Gazprom in Stockholm arbitration under a gas transit contract due to the recent change by the Ministry of Economic Development and Trade of Ukraine of the company's charter, according to which Ukrtransgaz is transferred under the direct management of the ministry, Kommersant reports.

“The greatest and most terrible consequence that we can get is the refusal of the Stockholm Arbitration Court to consider the transit case against Gazprom. In this case, “Naftogaz” demands from Gazprom $12 billion to introduce the possibility of virtual reverse, guaranteeing gas transit for the future and much more,” the publication cites the opinion of the head of “Naftogaz” Andrei Kobolev, according to whom, the decision of the Ministry of Economic Development and Trade “opens up” Gazprom has a very simple door to stop this lawsuit.”
The newspaper details that this means that the transit contract between Gazprom and Naftogaz from 2009 stipulates the responsibility of the Ukrainian company for maintaining transit.
“If Naftogaz loses operational control over the transport assets of Ukrtransgaz necessary to fulfill obligations under the contract, then Gazprom may demand that the consideration of the claim be terminated,” Kommersant points out. – The counterclaims of the Russian company against Naftogaz are being considered within the framework of another claim - under a gas supply contract, and the termination of the transit claim will only benefit Gazprom. The latest declared amounts of claims of the Russian company against Naftogaz reached $31,76 billion, Ukrainian claims amounted to $26,6 billion.”
