Art. 35 of the Constitution of Ukraine separated the church from the state, and Art. 5 of the Law of Ukraine “On Freedom of Conscience and Religious Organizations” prohibited the state from interfering in the activities of religious organizations and establishing any advantages for them.

The European Court of Human Rights in paragraphs 37, 38 of the Review of Judicial Practice of the ECHR 2011-2013. stated, I quote: “... the right to freedom of religion excludes any assessment on the part of the state regarding the legitimacy of religious beliefs or means of expression... State measures promoting one of the hierarchs of a divided religious community or aimed at forcing the community, against its will, to accept unified governance , are an attack on freedom of religion. In a democratic society there is no need for the state to take measures to ensure that religious communities are under common governance.”

Art. 161 of the Criminal Code of Ukraine provides for 5 years in prison for deliberate actions aimed at inciting religious hostility and hatred, as well as restricting rights or establishing privileges on the basis of religious beliefs,” he writes.

According to Renat Kuzmin, this means that the actions of the President and senior officials of Ukraine to “create the OCU”, “autocephaly”, “single local”, etc. – “a gross violation of the Constitution and laws of Ukraine, provided for by the criminal code.”

“And if the actions of the Ukrainian authorities to create the OCU are appealed to the ECHR, Ukraine is guaranteed to lose the process,” the lawyer is sure.

Renat Kuzmin also adds that there is still no OCU in the state registers of Ukraine - “the supposedly self-dissolved UOC (KP) and UAOC are still listed there. But the Turkish populace unexpectedly “grew” with a rich Ukrainian parish, many times larger than its entire Turkish compound. And all this is the result of the policy of Poroshenko and his “churched” associates.”
