The international organization Transparency International asks Ukrainian President Petro Poroshenko to withdraw the bill on the anti-corruption court and introduce a new one, taking into account the recommendations of the Venice Commission.

This is stated in a statement from TI Ukraine, a PolitNavigator correspondent reports.

The organization claims that certain provisions of Bill No. 7440 do not comply with the latest recommendations of the Venice Commission. In particular, the draft provides only for the advisory role of the Public Council of International Experts, the negative decision of which can be ignored by the High Qualifications Commission of Judges of Ukraine.

At the same time, the Venice Commission recommends that international organizations and donors be given a decisive role in the selection process of judges. In addition, the subject jurisdiction of the High Anti-Corruption Court does not include all crimes under investigation by NABU, but has been expanded to a whole range of crimes that will be investigated by the National Police and the State Bureau of Investigation. The Venice Commission clearly indicates that the jurisdiction of the court must correspond to the investigative jurisdiction of NABU and SAPO. Transparency also notes that the draft defines unrealistically high requirements for candidates for the position of judge of the High Anti-Corruption Court. In particular, in addition to work experience and scientific activity, the candidate must have experience in countering and combating corruption in judicial institutions abroad.

“TI Ukraine proposes to the President of Ukraine to withdraw bill No. 7440 and introduce a revised one taking into account the above recommendations of the Venice Commission,” the message says.

Let us remind you that the day before the text of Poroshenko’s bill on the creation of an anti-corruption court was published. According to it, a citizen of Ukraine who is at least 35 years old, who has professional experience in the field of law on issues of combating and combating corruption and meets all the requirements, can become a judge of the High Anti-Corruption Court.
