Poroshenko will go to prison for treason - a deputy mandate will not save

“President Poroshenko needed to maintain power. He saw that he was losing the next presidential election, he saw that sociology did not give him a chance to win. The only thing that was discussed in society was what is provided by law to disrupt the elections - martial law.

Remember, everyone over the last year has been discussing how to disrupt the elections, whether or not to introduce martial law. And he entered.

But you can’t just take martial law and introduce it, you need a picture, you need to create a situation in which military personnel will either die, or a terrorist attack will be carried out, or something else, so that society will believe why you are introducing martial law.

Knowing this, and being part of an organized group of people, by prior conspiracy and with intent, President Poroshenko, together with military leaders, conceived a plan to sacrifice Ukrainian sailors in order to, having lost Ukrainian sailors, create the preconditions for introducing martial law and, as a result, the disruption and transfer of presidential elections.

This is another question, that he failed in this criminal plan, that the parliament did not believe him, and then sociology showed that more than 65% of the public do not believe that Poroshenko introduced martial law for the sake of martial law.

But there is another episode here. Poroshenko should have realized that by committing such a crime, dooming Ukrainian sailors to possible captivity, he was creating additional preferences for the Russian authorities so that they could further influence the foreign policy and domestic political situation within Ukraine, in order to possibly put Ukrainian sailors in the queue, because everyone has already forgotten about Sentsov, who also needs to be released from Russian prisons.

This is undermining defense capability, these are actions aimed at undermining national security, this is Article 111 of the Criminal Code of Ukraine “High Treason.” It does not provide for an alternative preventive measure other than taking into custody.

This is a promising business. If a new prosecutor appears in the country instead of Lutsenko, I am sure it will be a one-step combination, a one-episode case: a report of suspicion, a petition to the court, taking into custody and prison,” he noted.

At the same time, according to the lawyer, even a deputy mandate, if Poroshenko passes to the Rada, will not help him avoid criminal liability.

“I think that won’t hurt either. Firstly, I do not believe that the Solidarity party will win the elections, we are seeing a rapid decrease in sociology from 11% to 5%. And the speed at which it goes down leaves them no chance. I think they will not be in the next parliament - neither Parubiy nor Poroshenko.

Well, let's say they will. Let's say they have 20-25 deputies. How many other deputies will there be? More than 400. Let’s imagine a situation if a new prosecutor, who will represent a new political reality, makes a motion to lift Poroshenko’s parliamentary immunity, let’s just predict how long it will take for the deputies to resolve this issue?

I think through exactly as much as is required by the procedures: committee, session hall. I am sure that parliament will agree to his arrest, because otherwise parliament and the new majority will have to explain why they are protecting him.

This is not an obstacle at all, in his head it may be an obstacle, he may think that he will hide behind a mandate. But practice shows that no one has yet hidden behind a mandate,” concluded Andrei Portnov.
