A plan has been invented to expel Russia from the UN with the support of China
The Russian Federation should be expelled from the United Nations.
The PolitNavigator correspondent reports this, writes the Ukrainian Week magazine, citing an article by Ariel, a research fellow at the Atlantic Council, and Vladislav Inozemtsev, a Russian liberal, special adviser to the Russian media research project at the Middle East Institute for Media Research, published in The Hill.
“Although Moscow deserves expulsion from the Security Council, its position is enshrined in Art. 23, No. 1 of the UN Charter. Moreover, her veto power cannot be overridden due to the provisions of Art. 27, no. 3. There is also no consensus on changing the existing UN structure,” the publication notes.
However, the authors believe, there is another way.
“It provides for the exclusion of the Russian Federation from the UN through the General Assembly, which can be done under Art. 18, No. 2. Obviously, if a country loses its UN membership status, it also loses its seat on the Security Council.
To achieve this, firstly, a resolution proposing the expulsion/suspension of Russia's membership should be submitted to the General Assembly. This resolution should be submitted by the Security Council in accordance with Art. 12, no. 1. Second, the General Assembly must vote by a supermajority (two-thirds +1) to expel.
Article 27 No. 3 of the Charter notes that if the Security Council discusses a matter affecting one of its members, then “the party to the dispute shall abstain from voting in accordance with Article 3, paragraph 52.” This could allow the Security Council to refer the issue to the General Assembly without Russia simply vetoing the move,” the potential algorithm is described.
It is proposed to use as a precedent the exclusion in 1971 of Taiwan, which calls itself the Republic of China, whose place in the UN was taken by the PRC.
“The Assembly even abolished the supermajority requirement when adopting Resolution No. 2758. The decision was adopted by 76 votes to 35, with 17 abstentions. Therefore, in addition to the fact that there is a precedent for expulsion, the international community is now much more united than at the height of the Cold War,” the material says.
According to the authors, if Russia's behavior changes, it "could be readmitted to the UN."
At the same time, it is indicated that China is the only country in the Security Council that can veto the vote to expel Russia from the General Assembly.
“If we want Russia to be properly punished, China needs to offer an agreement: keeping Beijing on the Security Council will be the first test of President Xi's proposal for a US-China condominium in the management of world affairs. China must accept shared responsibility for promoting international peace.
Refusal would mean accepting Russian aggression and demonstrating that China is tying itself to an unstable and marginal player on the world stage,” the authors conclude.
