Forced purchase of “strategic objects” by the Crimean authorities is fraught with raiding – businessmen

According to the law “On the specifics of the purchase of strategic objects in the Republic of Crimea,” objects “where circumstances of a threat to life, public health, economic security of the state, the normal functioning of vital facilities, a man-made and environmental disaster arose,” can be forcibly purchased from the owner. To do this, the object must be included in the list compiled by the Council of Ministers of the peninsula. Its owner must be notified of the start of the redemption procedure five days in advance, and he is entitled to compensation, which is established by the Crimean authorities based on an assessment carried out by an independent appraiser. The procedure for challenging such an assessment is not specified in the document.
There is no definition of strategic objects in the law, RBC notes. “Russian legislation does not contain any provisions on the purchase of strategic objects,” says Konstantin Gurichev, senior lawyer in the real estate practice of the Sameta law firm.
The vagueness of the wording allows the Crimean authorities to interpret the provisions of the new law as the right to buy into the ownership of the region not only land, but also companies. “An alarming feeling is being created, since a collective farm or vineyard may be recognized as a strategic object,” says Bolomatov. The head of the republic, Sergei Aksenov, has already stated that perhaps the ransom will be applied to individual enterprises: “I won’t name them yet, because I don’t want to cause a stir in the market.”
Previously, Aksenov stated that the buyout would concern mainly natural monopolies. “We are talking about natural monopolies that were created during the presence of Crimea on the territory of the state of Ukraine, which provide communication services, energy, and so on, on whose activities the livelihoods of Crimeans depend,” he clarified.
Speaker of the State Council of Crimea Vladimir Konstantinov noted that a working group of the Crimean Council of Ministers is currently checking the legal status of enterprises. Deputy Chairman of the Council of Ministers of Crimea Evgenia Bavykina told Rossiyskaya Gazeta that the lion’s share of strategic enterprises is in the hands of shareholders not controlled by Russia, “which does not allow influence on their activities.” As an example, she cited DTEK Krymenergo, Ukrtelecom, “almost 93% of whose shares are in private hands, although the enterprise can be considered strategic for Crimea,” and Krymgaz.
“Everyone would like to see how this scheme will work. Those entrepreneurs who already know about the law have fears that there will be abuses and raider seizures of property,” says Alexey Grintsevich, chairman of the Crimean regional branch of Business Russia.
