This is stated in the court decision dated December 26, 2017, a PolitNavigator correspondent reports.
It is noted that according to the case materials, Kievkhleb used packaging for the Fairytale Key cake, similar to the design of the packaging for the Golden Key cake produced by Roshen, which could lead to mixing the activities of the two companies. In addition, the court prohibited Kievkhleb from submitting to the Ministry of Economic Development and Trade of Ukraine for official publication an application to grant any person permission to use the mark for goods and services under Certificate of Ukraine No. 228350 and to refuse the certificate.
On December 6, the Antimonopoly Committee of Ukraine, at the initiative of the Roshen corporation, fined the Kievkhleb company 219 thousand hryvnia for using in its activities a cake packaging design similar to the design of the corporation’s confectionery product. The Antimonopoly Committee noted that Roshen had previously begun to use this design in business activities.
