“Roshen” sued “Auchan” for the rights to the cake on the second attempt
The Kyiv Economic Court found that Bellaria LLC violated the intellectual property rights of the Roshen confectionery corporation in terms of the use of the name Kiev cake and Kiev cake, as well as design elements of the cake packaging in the form of chestnut leaves, a PolitNavigator correspondent reports.
This is stated in the court decision dated March 15.
According to the court decision, Bellaria LLC is prohibited from using the designation Kyiv cake and Kyiv cake on the packaging of cakes, as well as chestnut leaves in the design of the cake packaging. The court ordered the destruction of all packaging and labels that the company has that violate the ban, since they can easily be confused with the packaging of the Kyiv Roshen cake. The court made similar demands to the Auchan hypermarket.
Also, both Bellaria and Auchan must pay legal costs.
Previously, Kyivkhlib lost a case of plagiarism of cake packaging to Roshen.
