A Russian bank wants to recover money from Poroshenko in court

The Russian VTB Group may recover from Ukrainian President Petro Poroshenko the amount it spent on purchasing Mriya Bank from him.

“In September, the Kiev Court of Appeal, within the framework of proceedings for the recognition and enforcement on the territory of Ukraine of the decision of the international arbitration court in The Hague on the claim of the Kolomoisky group companies against Russia, showed legal nihilism and, recognizing the assets of VTB (Ukraine) as the property of Russia in Ukraine, made a decision on arrest of shares and assets of VTB Bank (Ukraine). This, in fact, paralyzed the work of our bank in this country.

Kolomoisky’s actions deliberately strengthen the illegal sanctions that the Ukrainian leadership imposed in March 2017 against Russian banks. It is obvious to us that the Ukrainian authorities, with their tacit approval, actually encourage the raiding of their oligarch, despite the fact that ordinary Ukrainian citizens will ultimately suffer.

We would also like to remind Mr. P.A. Poroshenko that VTB (Ukraine) was built on the basis of Mriya Bank, which he owned and which VTB Group acquired from him in 2006. VTB Group reserves the right to apply to an international court for recovery from Mr. P.A. Poroshenko, the amount of funds spent on the purchase of the bank,” the bank said in a statement.

According to economist Alexander Okhrimenko, there are prospects for such a case, and the VTB group can really sue Pentra Poroshenko for a significant amount.

“If this is truly a European court, then VTB may win the case against Poroshenko. They are not interested in who it is - the president, the Pope or anyone else. It is a fact that this bank was bought from Pyotr Alekseevich. Nobody argues with this. Everyone will confirm that the money was paid. And the fact that now this bank is not being allowed to work normally is also provable; documents can be provided in this regard. There are blockages, various decisions, statements from Pyotr Alekseevich himself, etc. As a result, the VTB Group can actually apply for reimbursement of the funds it spent, for compensation for lost profits. They can calculate how much they lost in profit. This practice exists, it is normal in the global economy. Plus direct losses - how much they lost as a result of this transaction. And they have the right to file for moral damages. And the total amount can be mind-boggling.
Thus, it is possible to win a case in a European court against the President of Ukraine. The question is what kind of court this is. I would, of course, advise contacting London. “They really have the most independent, most unbiased court,” the economist said in a comment to a PolitNavigator correspondent.
