This was reported by the press service of the Russian Ministry of Justice.
“According to Article 471 of the Criminal Procedure Code (CCP) of the Russian Federation, the transfer of a person may be refused if... a court or other competent body of a foreign state does not recognize a sentence of a court of the Russian Federation or a court or other competent body of a foreign state recognizes a sentence of a court of the Russian Federation without establishing the procedure and conditions serving the sentence by the convicted person,” the press service said in a statement.
It notes that “when the Russian Ministry of Justice receives a request to transfer a convicted citizen of Ukraine to further serve a sentence of imprisonment in the state of his citizenship, it will be considered in accordance with the provisions of the Convention on the Transfer of Sentenced Persons and the Code of Criminal Procedure of the Russian Federation.”
