The State Duma intends to adopt a bill on this in the second reading on November 11. And it will become more difficult and expensive for migrants themselves to obtain the right to legally work in Russia, writes МК. What will happen after the New Year in the regional branches of the Federal Migration Service, already crowded with migrants and refugees from Ukraine, if millions of guest workers come there in person, whom employers are now legitimizing, having received or outbid the quota, is unknown.

Now all foreigners (both from countries with a visa regime and from visa-free CIS countries), in order to have the right to temporary work at enterprises and organizations in Russia, must obtain permission from the FMS. And employers have the right to hire guest workers only within the quotas established annually. Those foreigners who want to work in Russian households as nannies, gardeners, drivers or housekeepers are required to buy a patent.

Starting from the New Year, the quota system is abolished - all visa-free guest workers are transferred to the patent system. This is the lion's share of foreign workers in Russia. Those who will have a work permit or an old-style patent in their hands on January 1 may not worry until these documents expire.

But the rule “in which region you received the document, work there” remains unchanged. For those who draw up documents, for example, in the Tver region, but will work in the Moscow region, new administrative fines are introduced: 2-5 thousand rubles with or without deportation from the Russian Federation. Employers will also be seriously punished for attracting a migrant with a patent from a neighboring region: a fine of 250 thousand to 800 thousand rubles, the alternative is suspension of activities for up to 90 days.

To obtain a patent, a foreigner who entered Russia without a visa must apply to the FMS office of the region where he wants to work within 30 days after crossing the border. If he arrives later, he must also attach to the package of documents a receipt for payment of a fine of 4–5 thousand rubles.

In addition to the application form, which is still unclear, you must attach a migration card, which indicates that the foreigner entered specifically for work; a health insurance policy purchased in Russia (primary care and specialized emergency care), certificates received in Russia confirming the absence of diseases dangerous to society and that he is not a drug addict; a document confirming knowledge of the Russian language, knowledge of the basics of Russian legislation and Russian history; registration information. The patent validity period is from 1 to 12 months. It can be extended for a maximum of one more year.

Two months after receiving a patent (more precisely, its purchase - because in addition to the above papers, you need to pay a fixed amount in advance - like a personal income tax), you should also provide the FMS with a copy of the employment or civil law contract with the employer (customer) . And the FMS will then check whether this is a real organization and whether the migrant actually works there.

The employer must also notify the FMS that he has hired a foreigner with a patent - within 3 days, by mail or via the Internet. Violation of this rule faces a fine of 400 thousand - 1 million rubles.

The bill talks about the creation of special centers in the regions, which, on the basis of agreements between the regional authorities and the Federal Migration Service, must accept documents, issue patents to migrants arriving there and “assist” employees of this department in fingerprinting and photography. But at a meeting of the Committee on Constitutional Legislation, a representative of the FMS said that there is only one such center in Russia - in St. Petersburg. In Moscow, one is being built, but it is unknown whether it will work by the New Year, and in other regions the horse was not lying around due to lack of money, the newspaper writes.

If we abandon intermediary schemes right now, the migration department predicts crowds of Uzbeks and Tajiks near FMS offices in large cities, dirt, unsanitary conditions and indignation of local residents. As a result, the text of the bill stated that until 2017, in those subjects of the Russian Federation where there are no special centers, migrants will be able to submit documents to the FMS and through intermediaries, and in those where there are centers, only in person.
