The State Duma rejected the bill of the “A Just Russia” faction, which proposed to give citizens of Ukraine the right to obtain citizenship or residence permits in Russia without providing the necessary certificates from the migration service of their country.

The deputies explained the need to adopt amendments to a number of legislative acts by the fact that currently a number of provisions of Russian legislation make it impossible to obtain a residence permit and Russian citizenship for citizens of Ukraine recognized as native speakers of the Russian language.

Thus, the legislation provides for the need to renounce the citizenship of another state in case of obtaining a residence permit or citizenship of the Russian Federation. Such an application for a foreign citizen’s renunciation of another citizenship in accordance with current legislation is submitted to the authorized body of a foreign state. At the same time, in order to make a decision on issuing a residence permit, it is necessary to have a document from an authorized body of a foreign state confirming the application of this foreign citizen with an application to renounce his existing citizenship of a foreign state.

At the same time, according to the legislation of Ukraine, a notification procedure for renouncing the citizenship of a given state is not provided. For persons wishing to renounce Ukrainian citizenship, the legislation of Ukraine defines the appropriate procedure for registering the renunciation of their citizenship, which involves the submission by the applicant of a set of documents, payment of the consular fee, consideration of documents by the competent authorities of Ukraine, adoption and signing by the President of Ukraine of the corresponding Decree on renunciation of citizenship with the subsequent issuance of the corresponding certificates

Thus, the legislation of Ukraine contains a multi-stage procedure for renouncing citizenship, which in itself cannot be grounds for adopting the provisions proposed by the bill, the deputies indicated.

The Committee on Constitutional Legislation and State Building had not previously supported the bill. “The establishment of preferences initiated by the bill in relation only to citizens of Ukraine when accepting Russian citizenship may entail a certain actual infringement of the rights of citizens of other foreign countries wishing to acquire citizenship of our country,” follows from the text of the conclusion.
