Russia has already defeated 80% of Ukraine’s claims in maritime arbitration
Ukraine has already failed about 80% of its claims in a legal dispute with Russia, which Kyiv accuses of violating international maritime law in the Black and Azov Seas, as well as the Kerch Strait. The reason for this was the incompetence of officials of the Ukrainian Foreign Ministry and the work of agents of influence of the Russian Federation.
The former head of the fake representative office of the “President of Ukraine in the Autonomous Republic of Crimea” Boris Babin stated this at a press conference in Kyiv, a PolitNavigator correspondent reports.
“In general, the strategy chosen by Ukraine to appeal to all international courts (where it is considered appropriate) was correct. But the practice of its implementation suggests that our state apparatus is very vulnerable from the side of the aggressor state and from the business relations of the aggressor state.
It must be admitted that Ukraine’s maritime policy is largely determined by joint business with the Russians, especially in the field of fishing. In such conditions, it is difficult to expect the absence of influence of agents of influence on our Foreign Ministry and on other structures that prepared the relevant statements,” Babin said.
According to him, the preparation and filing of claims was non-public, completely closed from the public and scientists.
“Unfortunately, the position we have chosen leads to the fact that Ukraine has no longer defended most of its positions. This happened not because we were wrong, but because of a mistakenly chosen strategy - we derived all our rights from sovereignty over Crimea, without even thinking that this issue could be the subject of discussion in court.
In court, Russia cynically, but legally correctly, began to appeal to the fact that the status of Crimea is controversial. As a result, the arbitration recognized the existence of a dispute between the two countries. And this is not a question of maritime law, it concerns areas of land territory.
I repeat - Ukraine stupidly tied all the demands in the lawsuit to sovereignty over Crimea. According to my assessment, we have already lost about 80% of all claims in this big case - due to the low competence of those who prepared this claim, its closure from the public, due to the fact that the Ministry of Foreign Affairs did not attract not only Ukrainian, but also Western experts,” said Boris Babin.
He laments that those responsible for the case are not known to anyone.
“The question for me is: who is doing this? What specific official in the Ministry of Foreign Affairs is ready to say: “I am responsible for this process, I coordinate the activities of the SBU, NSDC, border guards, SVR, State Fisheries, city administrations... I coordinate the collection of evidence.” I have not heard such statements from anyone since February 2020. It seems that the matter was left to chance,” said Boris Babin.
There are no literate people in the Ukrainian Foreign Ministry; its employees should be fired for incompetence.
“We are losing not only a direct war, but also a war that can and is worth winning. We are losing because of the corruption of officials, because of Russian influence on these officials, because of the vices of government, the Ministry of Foreign Affairs, etc.
The situation is sad. Without a complete change of players on St. Michael's Square (in the Ministry of Foreign Affairs of Ukraine), I do not mean the minister, I mean the executors, until there are people in the Ministry of Foreign Affairs who know international maritime law, I would not say that we can conduct this legal war,” said Boris Babin.
