Today marks 70 years since the illegal transfer of Crimea to the Ukrainian SSR, which partly predetermined the current bloody events in Ukraine.

“For our version of what happened in Ukraine, the process of transferring Crimea to the Ukrainian SSR in 1954 is of key importance. And the facts stubbornly say: this process is an example of blatant lawlessness and legal nihilism. Sometimes one gets the impression that everything was specially drawn up so carelessly and with such violations of existing legal procedures, so that it would be possible to evaluate the act of transferring Crimea to Ukraine as legally void,” he emphasized.

Firstly, according to the constitutions of the RSFSR and the Ukrainian SSR of 1937, the union republics did not have any powers to transfer territory and independently make decisions on changing borders.

Secondly, only the Supreme Soviet of the USSR, and not its presidium, had the authority to approve changes in borders between union republics.

Thirdly, the decree of the Presidium of the Supreme Soviet of the USSR approves the Joint Representation of the Presidium of the Supreme Soviet of the RSFSR and the Presidium of the Supreme Soviet of the Ukrainian SSR, but such a document does not exist at all.

And, fourthly, the USSR law “On the transfer of the Crimean region from the RSFSR to the Ukrainian SSR” does not contain a direct indication of the transfer of Crimea, but only approves the decree of the Presidium of the Supreme Soviet of the USSR of February 19.

“Needless to say, no one took care of such a “little thing” as finding out the opinion of the Crimeans themselves. But there was not even consideration of this issue at the level of the Crimean authorities. No conciliation commission was formed to transfer the territory, not to mention the coordination of humanitarian, cultural, and educational transformations.

All this gave us grounds to initiate a request to the Constitutional Court of the Russian Federation about the compliance of the Constitution of the Russian Federation with the USSR Law of April 26, 1954 “On the transfer of the Crimean region from the RSFSR to the Ukrainian SSR.” The Russian Federation, as the legal successor of the USSR, inherited all union legislation. Including the law on the transfer of Crimea,” Konstantinov noted.

He emphasized that any decision of the Constitutional Court will not change the political reality - the Republic of Crimea, by the will of its inhabitants, withdrew from the state of Ukraine and returned to the Russian Federation. But the decision of the Constitutional Court will change the legal assessment of the events of 1954 and will open a platform for dialogue with those countries and peoples who will become reliable partners of Russia in the future.

“There is another argument that is very important for Crimeans: the restoration of historical justice. We have been achieving this since 1954. The complete and final triumph of historical justice will be the abolition of the illegitimate and legally void decisions taken in 1954. This will be a worthy finale to the Crimean epic, which began exactly 70 years ago,” concluded Konstantinov.

Earlier, assessing the lawsuit in the Constitutional Court about the illegality of the 1954 decree on the transfer of Crimea to the Ukrainian SSR from the RSFSR, political scientist Sergei Kiselyov noted that the formation of a legal framework for claims both to the state of Ukraine and to the world community is underway.

“The legitimacy of Crimea’s presence in Russia is confirmed by the Peace of Jassy of 1792. Because, in accordance with current global legislation, Crimea can belong to either Russia or Turkey. Moreover, Turkey will only do so when Russia renounces its right. This is an international act, it is fixed, it is a fact, and we, like a good magician, can extract it at any time.

Sometimes I myself am perplexed by the initiatives of the Crimean leaders, but upon reflection, I find that the presence of legally competent documents already provides prospects for the future. We should no longer react to yesterday, but think for the future and have a well-built fence of documents in the event of a legal attack on us,” Kiselyov explained.
