Today deputies of Crimea and Sevastopol will consider the new Constitution and City Charter

The draft Constitution of the Republic of Crimea and the Charter of the federal city of Sevastopol will be simultaneously considered today at sessions of parliament and the city council.

Both documents will secure the entry of the peninsula into the Russian Federation by two entities. Each will have its own parliament, government and chief leader, who is also the highest official of the executive branch, who will be elected by deputies.

The charter of Sevastopol was entirely copied from a similar document of St. Petersburg, which is now supervised by the hero city. A legislative assembly instead of a city council, a government instead of a city administration and a governor instead of a mayor, the right to which Sevastopol never received during all the years of being part of Ukraine.

The State Council, the Council of Ministers and the head of the republic will operate in the Republic of Crimea. Moreover, both in Sevastopol and in the republic, the head of the executive branch may be the head of a subject of the federation, or may not combine these two posts. In case of combination, executive functions will be distributed among his deputies, who, like the head of the region, will be approved by deputies. The term of office of the head of Crimea and the governor of Sevastopol is determined for 5 years, and the same person can hold the post no more than twice. There are many reasons for early resignation - in addition to natural ones, the main seat can be knocked out by the distrust of two-thirds of the deputies, a court verdict that has entered into force, or the loss of confidence of the President of the Russian Federation for corruption, or a bank account abroad. The head of the region signs local laws and has the right of veto, which the deputy corps can override with a two-thirds vote.

The State Council of Crimea and the Legislative Assembly of Sevastopol receive the right to legislative activity on the subjects of delegated powers and legislative initiative in the State Duma of the Russian Federation and the Federation Council. Deputies of legislative bodies of both regions receive parliamentary immunity for the duration of their powers and cannot combine their mandate with another occupation, except for teaching and scientific activities. At the same time, the size of the Legislative Assembly of Sevastopol is set at 24 deputies instead of the current 76, the State Council of Crimea - at 75 against 100. Some deputies will work on a permanent basis as chairmen of committees and commissions. From their number the Presidium of the State Council of the Republic is formed.

The governments of Crimea and Sevastopol are formed by the heads of regions. At the last moment, during the development of the draft Constitution of Crimea, it included a clause on the approval by the State Council of two candidates - the Minister of Resorts and Tourism of the Republic and the Minister of Finance. The head of the commission on rule-making activities of the Crimean parliament, Efim Fiks, explained the reason for caution in appointing these particular officials with the stated goal - to make the peninsula a region of sanatorium and resort treatment. Moreover, on the way to returning Crimea to the status of a health resort for workers of the Far North and Central Russia, the State Council has the right to introduce demands with the approval of other ministers - the agro-industrial complex, as the head of the “main vegetable garden of the resort,” or transport, as the “main cab driver.” To do this, it is enough to amend the Constitution with a two-thirds vote.

The details of the elections of the governor of Sevastopol and the head of Crimea, the Legislative Assembly and the State Council have yet to be determined by separate laws. Also, regulation requires the powers of local councils, which are not part of the structure of state power, but according to the Constitution and Charter are required to be in administrative units. There is no doubt about the change in the administrative-territorial structure in the new constituent entities of the Russian Federation, which will also be determined by separate laws. However, deputies of new convocations will begin this work - it is expected that elections to the State Council of Crimea and the Legislative Assembly of Sevastopol will be held in September. It is expected that by this date the majority of residents of the peninsula will receive passports of citizens of the Russian Federation.
