Semenchenko demands reparations from Russia for Crimea and Donbass - bill

In addition, the document notes that compensation for material and moral damage caused to the state of Ukraine as a result of the “temporary occupation” rests in full with the Russian Federation.

“Temporarily occupied territory” the bill proposes to consider land territory, internal waters of Ukraine belonging to these territories, sea waters and airspace of the Autonomous Republic of Crimea, the city of Sevastopol, cities, towns and villages of Donetsk and Lugansk regions, defined by the Resolution of the Verkhovna Rada of Ukraine “On the definition of individual districts, cities, towns and villages of the Donetsk and Lugansk regions, in which a special procedure for local self-government is being introduced.”

“Compensation for material and moral damage caused as a result of temporary occupation to the state, legal entities, legal entities and individuals is fully assigned to the Russian Federation as the state that carries out the occupation,” the bill says.

A special legal regime applies to the “temporarily occupied territory”. It provides for restrictions on free movement, a special procedure for making transactions, carrying out economic activities, holding elections and referendums, and exercising other rights and freedoms of man and citizen.

In addition, Semenchenko’s bill torpedoes the “Minsk process”.

The draft proposes to establish that any bodies, their officials and employees in the “temporarily occupied territory” and their activities are considered illegal if these bodies or persons are created, elected or appointed in a manner not determined by the Constitution and laws of Ukraine.

Ukraine, territorial communities, state bodies, local government bodies and other subjects of public law retain the right of ownership and other real rights to property, including real estate, including land plots located in the “temporarily occupied territory”. Thus, it is proposed to deprive the residents of Crimea, as well as the DPR and LPR, of their legal property rights.

Citizens of Ukraine have the right to enter and exit the “temporarily occupied territory” through entry and exit checkpoints, subject to presentation of an identity document confirming Ukrainian citizenship.

If citizens enter “temporarily occupied territory,” Ukraine is not responsible for their life and health.
