Sevastopol, March 19 (Navigator, Elena Ostryakova) – Shipowners and ship captains from Balaklava want the owners of the Golden Symbol yacht harbor, deputies from Batkivshchyna Andrei Senchenko and Sergei Velizhansky, to be deprived of their property rights. They are outraged that the money they paid for renting berths was used to finance Euromaidan.
“We petition Aksenov to consider the property rights of these fascist elements. Either they were nationalized or transferred to the Balaklava administration. There are private owners who harm the people. Senchenko and Velizhansky are just like that,” says one of the captains, Viktor Bychkov.

The shipowners and captains held a meeting at which they decided to create a public organization to exercise public control over the management of the Golden Symbol.
“Meeting participants are concerned about the real possibility that these political adventurers, in the conditions of their own financial collapse, may remortgage, resell, or destroy the property of the Golden Symbol yacht harbor,” the minutes of the meeting say.
It is noteworthy that the captains have no complaints about the activities of the Golden Symbol administration, although they consider the rent for the berths to be too high. The administration, on the contrary, is not enthusiastic about being controlled by a public organization.
“Golden Symbol” is a maritime enterprise. There must be order in the navy. It cannot be that the ship is controlled by an initiative group. The political platform of the owners is their personal business,” said Sergei Cherny, executive director of the Golden Symbol.
Despite his objections, the captains nevertheless chose the initiative group that would develop the charter of the public organization.
Let us note that the day before the meeting of Balaklava captains, Alexey Chaly, chairman of the coordination council of Sevastopol, spoke out on issues of private property. He stated that reprivatization would not take place in the city, with the exception of criminal cases, in which decisions would be made by the prosecutor's office.
In the case of the “Golden Symbol”, such a development of events is possible, since the ownership of this enterprise both to the berths and to the property complex has repeatedly become the subject of consideration in the courts.
Thus, in December 2013, the Kyiv Economic Court upheld the claim of the Deputy Prosecutor of Sevastopol and ordered the Sevastopol City Council to transfer berths No. 260 and 261, leased by the Golden Symbol, to the Ministry of Defense of Ukraine.
As the court established, these berths were transferred by the marine engineering service of the Russian Black Sea Fleet to the Sevastopol City Council in July 1995. At that time, the disputed property was not the state property of Ukraine, but remained all-Union property in accordance with the Russian-Ukrainian agreement on the principles of the formation of the Ukrainian Navy and the Black Sea Fleet of the Russian Navy from 1992 and was in joint use of the fleets of the two states. Thus, the Russian side did not have the right to transfer the berths to the city. According to the Russian-Ukrainian agreement on the parameters of the division of the USSR Black Sea Fleet (1997), berths No. 260 and 261 were transferred to the Ukrainian Navy.
Immediately after Viktor Yanukovych came to power, the courts ordered the Golden Symbol to return to the state the building next to the berths with an area of 350 square meters. Sales and purchase transactions concluded in 2006 with a branch of Ukroboronstroy without the knowledge of the Ministry of Defense were declared invalid. After 3 years, “Golden Symbol” managed to sue the building back.
The “Golden Symbol” owns almost the entire embankment of Balaklava. The club's main income comes not from small boats that take tourists during the season, but from owners of expensive yachts. Who these people are, only rumors are circulating around Balaklava, in which the names of Ukrainian and Russian politicians and businessmen appear. However, as the captains say, the revolutionary situation in the country did not in any way affect the movement of rich ships. Now there are slightly fewer expensive yachts than in the summer, but this is a common situation for the off-season.
