Sevastopol, June 27 (Navigator, Evgeniy Andreev) – By a decision of the Sevastopol Economic Court of Appeal dated June 25, the claim of the prosecutor’s office of the city of Sevastopol for the return of a land plot filed against the commercial enterprise “Duke Luke” was satisfied.

The claim was filed based on the results of an inspection of compliance with legislation in the field of children's health and recreation, during which cottages built by a third-party private entrepreneur for their own recreation were discovered on the territory of the municipal institution "Children's Sanatorium and Health Center "Laspi".
The prosecutor's office established that in April 2003, a cooperation agreement was concluded between the entrepreneur, the director of Laspi and the department of education and science of the Sevastopol City State Administration. According to the agreement, the parties agreed to jointly ensure full recovery and create better conditions for rest and leisure for children.
However, instead of comfortable conditions for schoolchildren, 5 two-story private cottages and a metal fence appeared on the territory of the health care institution, which fenced off about 0,09 hectares of land around these houses. Thus, according to this document, the transfer of a land plot belonging to a children's institution for development without legal grounds actually took place.
Having agreed with the prosecutor's demands, the court declared the 2003 contract invalid and ordered the entrepreneur to return the specified land plot to the municipal institution "DSOC "Laspi". The court's decision entered into legal force.
