The Federation Council of the Russian Federation exempted from criminal charges those caught while high
The Federation Council approved amendments to the federal law, according to which a case regarding the production or sale of narcotic and psychotropic substances cannot be initiated based on the fact that a person is intoxicated.
The document was presented during a meeting of the upper chamber by the Chairman of the Federation Council Committee on Constitutional Legislation and State Building, Andrei Klishas, reports a PolitNavigator correspondent.
He recalled that this law was rejected by the Federation Council in December last year, and added that a new version has now been presented, adopted by the State Duma as amended by the Conciliation Commission.
“The federal law establishes that the very fact that a person is in a state of drug intoxication or the discovery of narcotic drugs, psychotropic substances or their analogues in a person’s body cannot serve as a basis for initiating criminal cases for crimes provided for in Articles 228-1 and 228-4 of the Criminal Code of the Russian Federation regarding the illegal sale of these funds and substances,” Klishas said.
According to him, all the comments of the Federation Council that served as the basis for rejecting the federal law have been eliminated.
“In particular, the need to establish the subject of the crime during the pre-investigation check was completely eliminated,” the ancestor emphasized and added that consultations were held on this matter with both the Prosecutor General’s Office and the Ministry of Internal Affairs.
“It's good practice. When there are doubts about a particular law, we reject it, and within the framework of the Conciliation Commission with the State Duma we finalize it,” commented the Speaker of the Federation Council Valentina Matvienko.
All 103 senators in the hall voted for the approval of Federal Law No. 152.
