It became known why Ukraine does not terminate the agreement on the Sea of Azov
Although the excited patriotic Ukrainian public demands that the government break the agreement with Russia on the Sea of Azov, official Kyiv will not do this.
Elena Snigir, a leading specialist at the Center for International Studies of the Diplomatic Academy of Ukraine, writes about this in the Ukrainian publication “Mirror of the Week,” a PolitNavigator correspondent reports.
“The position of the Ministry of Foreign Affairs is that it is inappropriate to denounce this treaty due to the incompleteness of procedural issues in the arbitration proceedings of the UN International Tribunal for the Law of the Sea, where Ukraine filed a claim against Russia in 2016 for violating the latest UN Convention on the Law of the Sea. Based on the logic of the Foreign Ministry’s explanations, diplomats do not risk terminating the agreement that is part of this claim until the Arbitration Tribunal begins to consider the case on its merits. And judging by the order of procedural issues, this can be expected no earlier than in a year,” writes Snigir.
According to the author of the publication, even if the decision is made in favor of Ukraine, this does not mean a practical gain for it.
“The decisions of international courts in our favor will not protect us today or tomorrow, while the aggressor changes political reality through force. Indicative here is the experience of China ignoring the arbitration decision of the Permanent Court of Arbitration in The Hague in 2016. The Philippines, although it won on all 15 points of the claim, cannot exercise its rights in its own exclusive economic zone without military support from the United States,” writes Snigir .
