Kyiv, April 03 (PolitNavigator, Alexandra Ignatieva) – People's Deputy of Ukraine Alexander Gerashchenko said that the court should be guided not by the law, but by common sense, when considering the issue of the illegality of the termination of social payments in the Donbass.

“Yesterday, the Kiev Administrative Court of Appeal decided that the Cabinet of Ministers allegedly illegally limited social payments in the occupied territories, thereby violating the rights of pensioners, disabled people and other socially vulnerable groups of the population of the Donetsk and Lugansk regions,” Anton Gerashchenko wrote on his Facebook page .
“When making its decision, the court must, of course, be guided by the Law. The legal system in general has been based on this since the times of the ancient Romans.
But the court must also be guided by common sense, that is, explain in its decision how the executive authorities can implement the decision they have made,” the people’s deputy believes.
“The Cabinet of Ministers must, of course, challenge such a decision in the Supreme Administrative Court and at the same time propose to the Verkhovna Rada to make changes to the Laws that would not allow the courts to make decisions that are absurd, impracticable and contrary to common sense, following the lead of their former patrons,” Gerashchenko said .
