The court refused to restore the rights of a Crimean resident convicted by Ukraine of “separatism”

The Kiev District Court of Simferopol rejected the leader of the Popular Front “Sevastopol-Crimea-Russia” Valery Podyachiy in satisfying his claim to declare the refusal to hire unfounded due to a Ukrainian conviction for “separatism”.

He recalled that Podyachiy has not had the opportunity for official employment for about two years. Previously, he worked as a university teacher, however, when the contract expired, Podyachy lost his position due to a Ukrainian criminal record - he was persecuted by the SBU for calling for the return of Crimea to Russia.

“The reasoning part of the decision of the (Russian, mind you!!!) court is of particular interest. The following are only quotes from the Court Decision:

“According to Article 331 “The right to engage in teaching activities” of the Labor Code of the Russian Federation, persons who have or have had a criminal record, who have been subject to criminal prosecution (with the exception of persons for whom criminal prosecution was terminated on rehabilitative grounds) for crimes against the foundations of the constitutional order are not allowed to engage in teaching activities. and state security (in the singular – note).”

“From the certificate of the Information Center of the Ministry of Internal Affairs for the Republic of Crimea presented to the court and a copy of the verdict of the judicial panel of the judicial chamber for criminal cases of the Court of Appeal of the Autonomous Republic of Crimea dated February 28, 2011, it follows that Valery Viktorovich Podyachiy was found guilty of committing a crime under Article 110 Part 2 Criminal Code of Ukraine. This sentence came into force on September 15.09.2011, XNUMX.

Article 110 of the Criminal Code of Ukraine (as amended in 2001) provides for criminal liability for encroachment on the territorial integrity and inviolability of Ukraine, which refers to crimes against the foundations of the national security of Ukraine.”

“The court finds it established that V.V. Podyachy had a criminal record for a crime against the foundations of the constitutional order and the security of the state, which, in accordance with the provisions of Article 331 of the Labor Code of the Russian Federation, is a restriction on his access to teaching activities.”

“Thus, the judge of the (Russian!!!) court Tatyana Rube equated the territorial integrity of Ukraine with the territorial integrity of the Russian Federation!!! And in the Labor Code of the Russian Federation (if you follow its logic) we are talking about crimes against the foundations of the constitutional system and security, including that of Honduras?!” – Mordashov is indignant.
